Just because an application is within USCIS’s “normal” processing times, does NOT mean you can’t sue. Strong mandamus cases can be brought while an application is within normal processing times. This is especially true in instances where the delay is causing a hardship. For example, if an EAD delay causes you to lose a job, or a delayed travel document prevents you from visiting a sick relative — these can be strong mandamus cases.
