An unfortunate but frequent occurrence is when we have to turn away an immigration delay case because the potential client simply waited too long to contact us. For example, when someone reaches out saying their work authorization expires in a week and they will lose their job or forgo a great offer without an EAD – there is just not enough time for us to help.
When you file a mandamus lawsuit, the government gets 60 days to respond. It’s common that mandamus cases can be favorably resolved in less than 60 days (sometimes much less). That said, your odds of getting a positive result with a mandamus lawsuit increases if you give yourself some breathing room and file the case with more time on the clock before you absolutely need a decision on an immigration related application.
Don’t wait until the last minute.
